The terms “you”, “your” and “yours” refer to the surfer, customer or purchaser utilizing this Site to obtain Services. The terms “we”, “us”, “our” refer to MT Educare Ltd.

The Robomate Software refers to Robomate App and the Content for the course you have subscribed to, which is also referred to as Robomate Product.

Robomate Content refers to Course content and may contain any or all of the following types of files:

• Audio Video Lectures as .mp4 files. You require third-party media players to play this content.
• Study Material or Study Notes.
• Test Series.

The Robomate App refers to the Application developed by MTEL to securely browse and access the Robomate content for which the customer is subscribed to. This App should be installed on an end user device to use the Robomate Content. You can use one or more Robomate Products with the Robomate App.

Robomate Storage Media refers to Robomate Software with the App, Content and all associated files which are delivered on storage media such as USB flash drive (or pen-drives) or SD memory cards.

The Robomate Product Package refers to the following items:

• Robomate Outer Packing.
• Robomate Inner packing for housing and protecting the Robomate storage media.
• Robomate Storage Media.
• Instruction & Delivery booklet.

Robomate Product Validity Period refers to the date till which access to the product is valid.

The term Device refers to the device of the end user (customer), such as a personal computer, desktop, laptop, or tablet. As per the scope of these license terms, the following devices and operating systems are supported:

• Personal computer, desktop and laptop: Windows XP, Windows 2000, Windows Vista, Windows 2008.
• Tablets: Android tablets of specific models.

Registration signifies your agreement to these Terms. These Terms may be updated from time to time. This agreement sets out the legally binding terms for your membership. Your continued use of our services signifies your acceptance of the changes, effective upon notice to you as a member.

Company reserves the right, at any time, to modify, add to, delete from, alter, or update these Terms and Conditions (“Changes”), and you agree to be bound by such Changes. Changes shall be effective immediately upon notice thereof, which may be given by any means including, but not limited to posting on this Site or by electronic or conventional mail. You agree to regularly review the Terms and Conditions posted at this Site and to be aware of Changes. Your use of this Site following any Changes constitutes your agreement to follow and be bound by these Terms and Conditions as changed.

Cancellation or Refund is not allowed once you have installed Robomate product. In case you have received a damaged product, you can ask for a replacement by getting in touch with our Support Desk within 30 days from the date of receipt of delivery. Replacement will be subject to the item being returned in original condition and not damaged due to misuse. MT Educare reserves the right of refusal for any cancellation/replacement/refund.

We currently offer FREE DELIVERY on all orders. You do not have to pay any shipping charges. The estimated time of delivery is 7-10 working days from the date of Payment Realization (Not applicable for deliveries outside India). After payment realization, we will ship the item to the shipping address specified by you and will send you an email regarding the same.

We are committed to protecting your privacy. Your information will be used only for processing your order and to provide you with the best possible service. By Registering with us you provide your acceptance for receiving E-mails, Phone Calls, SMS, Notifications, and any other means of communication related to latest products, product updates, offers and other information which we feel might be useful for you. You have a right to refuse any marketing communication from us in the future by sending an e-mail to our Support Desk. We will never collect sensitive information about you without your explicit consent. We may use technology to track the patterns of behavior of visitors to our site. This can include using “cookies” which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings. If you have any questions/comments about privacy, you should contact us.

All content and services provided on or through this site are provided “as is” and “as available” for your use. The content is provided without warranties or conditions of any kind, either express or implied, including but not limited to implied warranties and conditions of merchantability, fitness for a particular purpose or non infringement. THE BRAND NAMES, TRADEMARKS, LOGOS, COMPANY NAMES USED ON THIS SITE BELONG TO THEIR RESPECTIVE OWNERS. BRAND NAMES, TRADEMARKS, LOGOS, COMPANY NAMES USED ON THIS SITE ARE FOR REPRESENTATION PURPOSES ONLY. Online education solutions does not warrant that the content is accurate, reliable or correct; that this site will be available at any particular time or location; that any defects or errors will be corrected or that the content is free of viruses or other harmful components. Your use of this site is solely at your risk. Because some jurisdictions do not permit the exclusion of certain warranties, those exclusions may not apply to you.

• Course Content is valid for access for the period as mentioned in the Product Details. Immediately after the validity.
• The contents on the Robomate Storage media should not be copied or formatted.
• The Robomate storage media will work with one device only i.e. once installed in a Computer or Tablet it will not work on any other device. If you try to install it, the Robomate Software may be blocked even in the original device in which you installed it.
• Delivery of Robomate Product Package is subject to payment realization.
• Your order will be delivered as per the Delivery Schedule communicated to you.
• Product once sold will not be replaced or exchanged. MT Educare will not be responsible for any damage / loss of Storage Media after sale.
• This content is meant to be used for students and not for commercial purpose. Unauthorized copying and distribution of content is liable to attract penalty under copyright laws.
• By buying this product you agree not to copy, duplicate or decrypt the content. For any such act, neither MT Educare nor its Resellers will be liable for any damage caused to your PC / Tablet device.
• We use third party remote support tools for providing after sales support for installation issues if any at your end. By opting for our product you have provided your acceptance to the use of such remote tools for resolving product related issues.

This license is applicable to you when you are licensed to use the Robomate Software for one or more Robomate Products. As per terms of this license, you are ONLY licensed to use the Robomate Software and you have NOT procured the Robomate Software itself. Robomate End User License: This license is applicable to you ONLY if you are an individual and intend to use Robomate Software for personal use only.

If you comply with the Robomate License terms, you have the rights below:

1. Installation and use rights.

• You may install and use only one copy of the software on your own device.
• You may use the software only to play the Robomate App and Content for personal use.
• You may not use the software for any other purpose, and that includes ‘commercial purpose’.
• You should not access the software from any device other than on which it is installed.
• You should not use the software in any manner which constitutes as IMPROPER USE.
• You agree to de-install the software and delete the content from Storage Media after the Course validity period.

2. Distribution

• You have no right to copy and distribute the software in its original form or any modified form.
• By installing this software, you agree that you will be in violation of Indian Copyright Act 1957 if you copy and distribute this software in its original form or any modified form MTEL reserves its rights to prosecute you under the applicable laws of the country.
• Should you copy and distribute this software, you indemnify, defend, and hold harmless MTEL and its affiliates and suppliers from any claims, including attorneys’ fees, related to your distribution of the software.
• You shall not alter any copyright, trademark or patent notices in the software.
• You shall not use MTEL’s or affiliates or suppliers’ name, logo or trademarks to market your products or services.
• You shall not distribute the software with malicious, deceptive or unlawful programs, or modify or distribute the software so that any part of it becomes subject to an Excluded License. An Excluded License is one that requires, as a condition of use, modification or distribution, that the code be disclosed or distributed in source code form; or others have the right to modify it.

3. Scope of usage of Robomate app and content

• This agreement only gives you some rights to use the software for a specific period, mentioned on the back leaf of ‘Instructions’ booklet in the Robomate product package.
• MTEL reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways.

You or your associates, directly or indirectly, may not

• Try to access the content directly from the Robomate Storage Media.
• Copy any content from Robomate Storage Media to your device.
• Try to install application on multiple devices.
• Delete any data from Robomate Storage Media.
• Add any personal files (Movies, games etc) to the Robomate Storage Media.
• Rename any files or folders in the Robomate Storage Media.
• Change the system date or time of your device.
• Performing any of the above activities is not permitted as per the License terms and you may be blocked from using the Robomate software further.
• You may have to pay additional amount to Robomate to remove the license block.

You or your associates, may not

• make more copies of the software.
• work around any technical limitations in the software.
• reverse engineer, decompile or disassemble the software.
• publish the software for others to copy.
• rent, lease or lend the software; or.
• Use the software for commercial software hosting services.

4. Licensing procedure By installing this software, you agree to the following Licensing Procedure:

• Before installing Robomate Software, you will set the system date and time of your device exactly as per the date and time of the geographical area in which you are installing the Robomate Software.
• You shall keep the storage media connected to your device through-out Robomate Software installation process and even whenever you are using Robomate Software.
• After installing Robomate Software, when you select the ‘OFFLINE’ button on the Robomate App, the Robomate Software will generate a key, unique to your device on which you are installing this Robomate Software and the storage media connected to your device.
• The key can be of 30-50 characters in length.

Installation with Internet

• If you are connected to Internet, the Robomate Software on your device shall automatically transmit the key through the Internet to Robomate App Server of MTEL.
• Subsequently, if the key is valid, the Robomate App Server will generate a License Key for your device and storage media and transmit this key back to your device.
• The Robomate Software installer on your device shall install the License Key of Robomate Software on your device and complete the installation.
• Now you can access the Product for which you have been issued license.

Installation with Mobile SMS

• If you do not have stable Internet connection on your device, you will have to send the correct key as a SMS from your mobile to the number 93217 93217.
• Subsequently, if the key is valid, the Robomate App Server will generate a License Key for your device and storage media and transmit the License key back to the mobile device from which you have messaged the device key.
• Now, you shall enter the License Key in the screen of the Robomate App on your device and complete the installation.
• Now you can access the Product for which you have been issued license.

5. License Validity
General
As per these License terms, the Robomate Software license is valid ONLY ,

• For your device on which the Robomate Software was first installed and registered with the Robomate License Key.
• If Robomate Software was procured within India.
• For the product for which you have procured the License.
• For the Robomate Software Course Validity Date mentioned in the ‘Instruction Note’.

Applicability to Robomate Software
This license and its terms are valid for Robomate Software, its updates, supplements, Internet-based services, and support services for this software. If other terms accompany those items, those terms apply.

Other Software
This license terms does not cover the usage or copyright terms and conditions of any or all of the third-party players and viewers required to use Robomate Software.

6. Improper Use Of Robomate Software
As per these License terms, following instances of usage are considered as IMPROPER USE of Robomate Software and hence, it may not work in such instances:

• If your device is infected by virus, malware, Trojan horse or any such harmful programs.
• If you have made a backup copy of the storage media.
• If you have replaced or removed any of the original files delivered with Robomate product package.
• If you tried to edit any of the original files delivered with Robomate product package.
• If you tried to change system date and time of your device.
• If you tried to install and/or use the Robomate Software on additional device after installing and registering it with a device earlier.
• If you tried to install and/or use the Robomate Software in thin-client environment or using any of the prevalent desktop virtualization technologies, products or solutions.

Blocking of Robomate Software
By procuring and/or installing the Robomate Software, you agree that the Robomate Software can be blocked on your device for any instance or instances of Improper Use of Robomate Software committed on your device by you or your associates.

7. Export Restrictions
The license of Robomate software is not for sale outside India. However, if you have purchased the license of Robomate Software in India, then you can install and use it anywhere outside India during the Robomate Software Validity Period. Please get in touch with our Support Desk for email us

8. Support Services
General

• For all support issues, you can contact our Support Desk at Robomate Center, ONLY during the Robomate Software Validity Period, as mentioned in the ‘Instruction & Delivery’ booklet of your Robomate Product Package.
• MTEL cannot provide support to you in all instances of IMPROPER USE and your app may also be blocked for these reasons.
• By signing this agreement, you authorize MTEL to download the Remote Desktop Support tool on your computer for installation, troubleshooting or any support required by you.
• You also agree that MTEL will have partial or full unrestricted access to your computer. MTEL will be able to transfer files to your device with or without additional authorization from you or make changes to the system files of your device.
• In no circumstances MTEL will be liable for any direct, indirect, punitive, special, exemplary, incidental, consequential or other damages of any type or kind (including without limitation system damage, loss of data, privacy, revenue, profits, use) or other economic advantage arising out of, or in any way connected with.
• the downloading, installation and use of Robomate Software on your device.
• the remote support provided by MTEL.
• MTEL cannot guarantee that all issues can be resolved through remote technical support. However, MTEL will make reasonable efforts to support Robomate Software.
• If an issue related to Robomate Software is not resolved through Remote technical support, you agree that you will bring our device to the Robomate Support Center of MTEL at your own expense, for further analysis and troubleshooting.

Support on MS Windows desktops and laptops

MTEL has tested Robomate Software on various models of laptops and desktops. However, MTEL does not guarantee the performance of Robomate App on any specific models of laptops or desktops due to the several situations beyond the control of MTEL, such as below, though not limited to:

• If you are using unlicensed Operating System Software in your device.
• If Antivirus Software not installed in your device.
• If the installed Anti-virus software blocks the Robomate App in your device.
• If the hardware configuration of your device does not meet the recommended system requirements.
• If important system files of your device operating system are corrupt.
• If windows media player files in your device are corrupt.
• If you have installed any OS patch or service pack or any other software or application that conflicts with the working of Robomate Software.

Support on Android tablets:

• MTEL has tested Robomate App on various models of Android Tablets. However, MTEL does not guarantee the performance of Robomate App on any of tablet models.
• MTEL continuously tests the Robomate Software on several models of popular brands of Tablets available in India. This list is published and periodically updated at the link apps.mteducare.com/tested tabs on our website.

Please contact our Support Desk ONLY within the Robomate Software Validity Period:

• If you lose your Robomate Storage Media.
• If you lose your device on which Robomate Software is installed and registered.
• If your device or any part of your device is damaged and you cannot use Robomate Software.

9. Use of Information
By installing Robomate software:

• You agree to Robomate Software and Support Tool capturing your system details.
• You expressly permit MTEL send Transactional, Promotional, Product information communications on your landline number, mobile number and Email Id.
• You agree to keep the License Key confidential. MTEL will not be held responsible for any issue arising out of sharing of License Key.

10. Entire Agreement
This agreement, and the terms for supplements, updates, Internet-based services and support services that you use, are the entire agreement for the software and support services.

11. Governing Law, and Exclusive Jurisdiction
This Agreement shall be governed and construed solely in accordance with the laws of India. By installing the software, you agree that courts of Mumbai shall have exclusive jurisdiction over any matter arising under this Agreement to the exclusion of all other courts.

12. Limitation & Liability

• MTEL has developed Robomate Software to help students understand portions of their educational curriculum through Audio Visual Content.
• However, MTEL and/or its Resellers shall not guarantee improvement in academic performance of students using Robomate Software.
• MTEL and/or its Resellers are not responsible for your academic performance or the academic performance of your ward.
• You cannot recover any damages including consequential, lost time or money, special, indirect or incidental damages.
• This limitation applies to the following items and/or circumstances:
• Anything related to the software, services, content, third party Internet sites, or third party programs.
• Claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law.
• Even if MTEL knew or should have known about the possibility of the damages.

13. Cancellation & Refund
By installing this software, you agree that you cannot cancel the order or your Robomate product license and no refund, whether full or partial, will be provided.
14. Third Party Advertising

• You agree that MTEL can communicate or display information, advertisement, and products related to third parties, through Robomate App.
• You agree that MTEL or the third parties make no representations about the suitability, reliability, availability, timelines of the products and services advertised on Robomate Software and MTEL or the third parties are not responsible for the correctness, viability, availability, or suitability of such information, advertisement and products.
• You agree that MTEL does not provide any guarantee or warranty or any representation on behalf of any of the advertisers or their associates.
• You agree that no services utilized through Robomate Software shall create any warranty.

15. Indemnification
By agreeing to install Robomate Software, you agree to protect and fully compensate MTEL and its associates, such as, resellers and technology partners, from any and all third party claims, liabilities, damages, expenses and costs, including, but not limited to, all legal expenses, arising from your use of Robomate Software, your violation of the terms or your infringement by any other use of your account, of any intellectual property or other right of anyone.

16. General
This Agreement does not in any manner create any relationship whatsoever as between you and MTEL, either as a joint venture, partnership, employment, or agency relationship. Performance of this agreement by MTEL is subject to existing laws and legal process in India, and nothing contained in this agreement is in derogation of the rights of MTEL to comply with governmental, court and law enforcement requests or requirements relating to your use of Robomate Software or information provided to or gathered by MTEL with respect to such use.

Unless otherwise specified herein, this Agreement constitutes the entire agreement between the user and MTEL with respect to Robomate Software and it supersedes all prior communications and proposals, whether electronic, oral or written, between the user and MTEL with respect to Robomate Software.

17. Copyright Information
All information related to Robomate Software, including but not limited to, its design, text, graphics, screen shots, content and system files and the selection and arrangement thereof is protected by copyright laws. (depicted as Robomate © MTEL)
